Simon Wright / Whirlpool is being sued due to comments made by Whirlpool users on the forums about a company " 2clix ".

wow that just bs.... Australia seriously needs a Bill of Rights or something to ensure a freedom of speech. Even though im sure this case will get thrown out or 2clix won't win, it's just a pain in the **** for whirlpool. Going by this case basically every company in Australia would have claims to sue someone.

Great resource for information and discussion? Maybe if they toned down the moderation by a factor of 1000, but until then I don't think so. This lawsuit is obviously retarded.

But if there isn't a disclaimer or part of the terms and cond's about the posts being that of the user and not the thoughts of Whirlpool then I guess they are pretty screwed.

Whirlpool isn't moderated that heavily btw - its just less transperant when it happens (instead of a post dissapearing, there is a big fat "BALETED!?" in the messae area

Well, it isn't known as Whingepool for nothing. Every ISP, mobile phone provider or apple picker will get beaten to death on Whirlpool by somebody, it's a fact of life, even people like iiNet will become targets. You don't go to Whirlpool for flattering comments.

The main issue is that their next name for it, "Platinum One" was being dragged into it.

at a legal stand point the liability stands on the forum owner and also the authors, for example if a newspaper publishes a false misleading etc... story they are both liable all he'll have to prove is that they where opinions and if the product was faulty he could subpoena witness to testify that they had serious problems with the software and they may of been mislead by sales person

I've had to setup 2clix software before... it is dodgy as hell.

The client POS systems often have problems talking to the server, and the backup feature never appeared to work properly(meaning risking losing all the data due to intermitten backup problems).

What I found reading back through the old threads, was that the users had actually stopped using the program and were giving someone thier opinion on the software. The Techy I don't think noticed that, why would they contact him if they no longer use the software to resolve issues.

On the main topic, I think it's a bad idea to sue WP over this matter, the greatest marketing ploy is word of mouth. In a company the IT team will discuss with other's software they use, problems faced, how good the support is and so on. All 2 clix seem to be doing is shooting themselves in the foot and crying foul that someone else did it, namely WP. I've posted there myself, I use it to check out ISP's and if my net drops, I look it up there first as I know someone will be having a whinge already. If all companies could do this, there would be no such thing as public forums for us as users to talk and discuss what we want. If I played a game and didn't like it say from EA, I would want to share why with the community so I could get feedback from them. If EA sued the forum owners, this would be the same, it's trying to silence the users.

I read in the old thread that a couple of users didn't have the issues and found the software good for themselves, but the larger based companies found that they couldn't use something with so many issues they faced. Ah IT, you have to love it.

yeah but they won't win because of public policy and if the statements made were true and of public interest (which as far as i can tell they are and all the pointless defamatory ones which other people responded to have been deleted) there is **** all 2clix can do. I am sure it will change WP forever though and i think that is the goal. Not to win, but certainly to still **** WP over. The damage has already been done to both parties.
