Terms and Conditions of Entry for the BigPond Giveaway Promotion
Information on how to enter and prizes form part of these conditions of entry. Entry into the promotion is deemed acceptance of these conditions of entry.
Entry is open to residents of Australia who are aged 18 years and over. Employees of the Promoter, the Promoter's associated companies, the Promoter's agencies associated with this promotion and their immediate families are ineligible to enter.
Promotional Period - The promotion commences at 12:01am (AEDST) on 1 November 2011 and closes at 11:59pm (AEDST) on 31 March 2012.
To enter the promotion, participants must during the Promotional Period register their details at BigPondGiveaway.com.au, to receive a special offer enewsletter from either BigPond Shopping, BigPond Music, BigPond Games and/or BigPond Movies, and agree to the terms and conditions ("eligible entrant"). All eligible entries will be automatically entered into the draw. Maximum of one entry per person in the draw.
The draw will take place at 2:00pm (AEST) on 3 April 2012 at 15 Grosvenor Street, Neutral Bay NSW 2089. The Draw will be made from all eligible entries received during the Promotional Period. The winners will be notified by email within 2 working days of the draw date and the winners of prizes valued over $250 will have their first initial,
surname and postcode published in The Australian newspaper on 11 April 2012.
There will be 4 prizes awarded in the draw. The first eligible entry drawn will receive the First prize choice of either;
a. Samsung 55 Inch LCD Television Series 8 UA55D8000Y and a $300 BigPond Movies Voucher (prize choice value is $4,999);
b. $5,000 BigPond Shopping Voucher (prize choice value is $5,000);
c. Yamaha Home Theatre Package YHT-1096AU and a $1,000 BigPond Music Voucher (prize choice value is $4,999); or
d. Dell Alienware Aurora ALX Gaming PC and Alienware OptXT 3D-Capable Monitor AW2310 and BigPond Games Voucher (prize choice value is $4,968).
The maximum retail value of the First prize is $5,000.
The next eligible entry drawn will receive the Second prize choice of either;
a. LG Full HD Cinema 3D LED LCD TV and LG Twin HD Recorder & 3D Blue-Ray Player with 500GB Internal Hard Drive and LG HLX55W Home Theatre Systems and $200 BigPond Movies Voucher (prize choice value is $3,497);
b. $3,500 BigPond Shopping Voucher (prize choice value is $3,500); or
c. Dell Alienware Aurora R3 with high performance CPU liquid cooling power packed with 2nd Gen Intel Core i7 processor and $500 BigPond Games Voucher (prize choice value is $3,398); or
d. Zeppelin Air Sound System AIR FP30570 and Western Digital - My Book World Edition II WDH2NC40000A and Apple iPod touch 8GB MC540ZP/A and Apple MacBook Air, 11-inch MC968X/A and $750 BigPond Music Voucher (prize choice value is $3,456).
The maximum retail value of the Second prize is $3,500.
The next eligible entry drawn will receive the Third prize choice of either;
a. LG Twin HD Recorder & 3D Blue-Ray Player with 500GB Internal Hard Drive HR699D and $300 BigPond Movies Voucher (prize choice value is $999);
b. $1,000 BigPond Shopping Voucher (prize choice value is $1.000);
c. Zeppelin Air Sound System AIR FP30570 and $200 BigPond Music Voucher (prize choice value is $999); or
d. Dell Inspiron 15R Laptop with 2nd Gen Intel® CoreT i7 processor and $100 BigPond Games Voucher (prize choice value is $999).
The maximum retail value of the Third prize is $1,000
The next ten (10) eligible entries drawn will each receive the Fourth prize choice of either;
a. 1 x $50 BigPond Movies Voucher;
b. 1 x $50 BigPond Shopping Voucher;
c. 1 x $50 BigPond Music Voucher; or
d. 1 x $50 BigPond Games Voucher.
The maximum retail value of the Fourth prize is $500.
Total maximum retail value of the prize pool is $10,000 (GST inclusive)
If any of the prizes are unavailable, for whatever reason, the Promoter reserves the right to substitute any of the prizes for a prize of equal or greater value, subject to state regulation and subsequent approval.
The BigPond Music, Shopping, Games and Movie vouchers are valid for 12 months from the draw date.
Prizes are subject to availability.
Entrants can only enter in their own name and use their own email address. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to validate and check the authenticity of any prize claim or entry before awarding a prize.
Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries.
Programming and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these conditions of entry, all valid prize claims in excess of the advertised prize pool will be honoured.
In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Prize.
All existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool have been exceeded.
The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these terms and conditions or forfeiting or not claiming a prize. If any prizes remain unclaimed as at 5pm AEST on 3 July 2012, a second chance draw will be held at the same time and place as the original draw on 17 July 2012 subject to any directions given under applicable law. Any winner/s will be notified by phone and in writing within 2 working days of the draw date and the winners of prizes valued over $250 will have their first initial, surname and postcode published in The Australian newspaper on 24 July 2012.
Printing errors or other quality control matters outside the control of the individual player shall not be used as the sole basis for refusing to award a prize.
The prize must be taken as offered and cannot be varied. Prize values are GST inclusive and are in Australian dollars and are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value.
The Promoter's decision in relation to any aspects of the competition is final and binding on every person who enters and no correspondence will be entered into.
The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit. Once prizes have left Promoter's premises, the Promoter will not be responsible for any delay in delivery, or failure of safe delivery of prizes.
Prize winners are advised that tax implications may arise from their prize winning and they should seek independent financial advice prior to the acceptance of the prize.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
The Promoter is not responsible for any incorrect or inaccurate information or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
All entries become the property of The Promoter. All entries will be entered into a database and The Promoter may use the entrant's names, email, addresses and telephone numbers on the terms and for the purposes (including marketing) set out in the Promoter's Privacy Statement available at www.telstra.com.au/privacy/privacy_statement.html or by calling 1800 039 059, as if they were a customer of the Promoter. If entrants do not consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below or phone 1800 039 059. Any request to update, modify or delete the entrant's details should be directed to The Promoter.
If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the promotion.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.
