Information on how to enter and prizes form part of these conditions. Entry into this Promotion is deemed acceptance of the conditions of entry.
The Promoter is Telstra Corporation Limited ABN 33 051 775 556 of Level 7, 151 Clarence Street, Sydney, New South Wales, 2000 ("Promoter").
Entry is open to Australian residents aged 18 years or over who are, or during the Registration Period become, registered members of GameArena ("Eligible Entrants"). Management, employees and contractors of the Promoter and other agencies, firms or companies associated with the Promotion (including the suppliers of prizes), and their immediate families are ineligible to enter. Registration for the Promotion will be open from 5pm Australian Eastern Standard Time ("AEST") on 19th October 2007 and close at 5:00pm AEST on 26 October 2007 ("Registration Period").
The Promotion will be open from 9:00am AEST on 29 October 2007 and will continue until 11:59pm AEST on 30 November 2007 ("Promotion Period"). The Enemy Territory: Quake Wars tournament will be conducted throughout the Promotion Period ("Enemy Territory: Quake Wars Tournament").
To participate in the Promotion, Eligible Entrants must join a team to participate in the Enemy Territory: Quake Wars Tournament in accordance with the Enemy Territory: Quake Wars Tournament rules (“Enemy Territory: Quake Wars Tournament Rules”), which are available at http://www.gamearena.com.au/competitions/etqw/ . Teams must have exactly 8 Eligible Entrants (no more and no less ) (“Eligible Team”).
Both the Enemy Territory: Quake Wars Tournament and this Promotion will be conducted on http://www.gamearena.com.au/competitions/etqw/ ("BigPond ETQW Website").
An individual Eligible Entrant may enter the Promotion once, i.e., they can only be a member of one Eligible Team.
To participate in the Promotion and be eligible to win, an Eligible Team must:
1. during the Registration Period, go to the BigPond ETQW Website and register to play in the Enemy Territory: Quake Wars Tournament by accepting the Enemy Territory: Quake Wars Tournament Rules;
2. indicate at the BigPond ETQW Website that they would like to participate in the Promotion by registering for the Promotion and accepting these terms and conditions; and
3. during the Promotion Period, play all Enemy Territory: Quake Wars Tournament games ("Games") allocated to that Eligible Team in accordance with the Enemy Territory: Quake Wars Tournament Rules.
Timing of Games depends on the total number of Eligible Teams. Game times will be scheduled by GameArena via an automated system. Allocated Game times for each Eligible Team will be emailed to Eligible Teams and published on the BigPond ETQW Website at the start of the Promotion Period.
The highest placed Eligible Team in the Enemy Territory: Quake Wars Tournament as at the end of the Promotion Period will be determined in accordance with the Enemy Territory: Quake Wars Tournament Rules, including scoring and elimination rules.
Eligible Entrants who withdraw, suspend or otherwise cancel their GameArena membership before the end of the Promotion Period or who are in breach of the GameArena terms and conditions before the end of the Promotion Period will be ineligible to win a prize.
The Promoter's decision in relation to the winners of the Promotion is final and binding and no correspondence will be entered into.
Each member (as listed in the Promoter's records) of the highest placed Eligible Team in the Enemy Territory: Quake Wars Tournament will receive from the Promoter a cheque in the amount of $1250.
Total value of the prize pool is up to $10,000.
The winning Eligible Team will be notified by email (to the contact email address provided by the Eligible Team) on 4 December 2007. The names of the winning Eligible Team and their members will be published on the BigPond ETQW Website on 4 December 2007.
The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. No responsibility will be taken for lost, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
Any Eligible Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process (including the Enemy Territory: Quake Wars Tournament Rules), will be ineligible to win.
The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry and the Promoter's decision in relation to any aspect of the Promotion is final and binding on each person who enters. No correspondence will be entered into.
In the event that there is a dispute concerning the conduct of the Promotion, including whether an Eligible Entrant has cheated or breached the Enemy Territory: Quake Wars Tournament Rules in any way or where Eligible Entrants or Eligible Teams have disputed the result of a Game, the decision of the Promoter is final and no correspondence will be entered into.
By entering the Promotion, the Eligible Entrant understands and agrees that the Promoter may use and disclose the information provided by the Eligible Entrant on the terms and for the purposes (including marketing) set out in the Promoter’s Privacy Statement available at www.telstra.com.au/privacy/privacy_statement.html or by calling 1800 039 059, as if you were a customer of the Promoter.. The Eligible Entrant agrees that we can continue to contact you even after this Promotion ends. If the Eligible Entrant would like to access or correct the personal information that the Promoter holds about the Eligible Entrant, or if the Eligible Entrant does not wish the information to be disclosed, the Eligible Entrant should advise the Promoter by phoning 1800 039 059.
Eligible Entrants agree that, in the event they are a winner in this Promotion, their personal information will be sent to Activision Pty Limited for the sole purpose of Activision organising delivery of the prizes to them.
By entering into the Promotion, the Eligible Entrant agrees and acknowledges that if they win:
1. the Eligible Entrant may be contacted by the Promoter to provide comments about the competition and the Promoter (or an agent of the Promoter) may take photos of the winner;
2. the Promoter may use such comments or photos (the "Materials") for the Promoter's future promotional and marketing purposes without further reference or compensation to the Eligible Entrant;
3. the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
4. the Eligible Entrant acknowledges that, by entering the Promotion, the Eligible Entrant grants to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;
5. the Eligible Entrant unconditionally and irrevocably consents to any act or omission that would otherwise infringe any of the Eligible Entrant's moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");
6. the Eligible Entrant waives all Moral Rights in the Materials that arise outside Australia; and
7. the Eligible Entrant agrees not to institute, maintain or support any claim or proceeding for infringement of the Eligible Entrant's Moral Rights in the Materials.
To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained in connection with this Promotion.
The Promoter accepts no responsibility for any tax liabilities that may arise from winning a prize.
