Battlefield: Bad Company 2 Tournament

- Information on how to enter and prize details form part of these conditions. Entry into this Promotion is deemed acceptance of these terms and conditions of entry.
- The Promoter is Telstra Corporation Limited ABN 33 051 775 556 of 151 Clarence Street, Sydney, New South Wales, 2000 ("Promoter").
- Registration for the Promotion will be open from 5:00pm Australian Eastern Standard Time ("AEST") on 1 March 2010 to 5:00pm AEST on 21 March 2010 ("Registration Period").
- The Promotion will be open from 8:00am AEST on 22 March 2010 and will continue until a clear winner is determined but no later than 5:00pm AEST on 9 May 2010 ("Promotion Period"). The Battlefield Bad Company 2 tournament will be conducted throughout the Promotion Period (the "Tournament").
Entry
- Entry is open to Australian residents aged 18 years or over who are, or during the Registration Period become, registered members of BigPond GameArena ("Eligible Entrants"). Management, employees and contractors of the Promoter, Electronic Arts Pty Ltd ("Electronic Arts") and other agencies, firms or companies associated with the Promotion (including the suppliers of prizes), and their immediate families are ineligible to enter. To become a registered member of BigPond GameArena, individuals must visit the registration page at https://secure.gamearena.com.au/account/join.php and accept the BigPond GameArena terms and conditions.
- To participate in the Promotion, Eligible Entrants must join a team in accordance with the Tournament rules (the "Tournament Rules"), which are available at http://www.gamearena.com.au/competitions/battlefield-bad-company-2/ ("Competition Website"). Teams must have a minimum of 5 and no more than 8 Eligible Entrants ("Eligible Team").
- An individual Eligible Entrant may enter the Promotion only once.
- To participate in the Promotion and be eligible to win, an Eligible Team must:
- during the Registration Period, go to the Competition Website, register to play in the Tournament and accept the Tournament Rules; and
- during the Promotion Period, play all Battlefield Bad Company 2 Tournament games ("Games") allocated to that Eligible Team in accordance with the Tournament Rules.
- Timing of Games depends on the total number of Eligible Teams. Game times will be scheduled by the Promoter via an automated system. Allocated Game times for each Eligible Team will be emailed to Eligible Teams and published on the Competition Website at the start of the Promotion Period. Eligible Teams not available at the allocated time for a Game will forfeit the Game and will be automatically eliminated from the Tournament.
- There will be no 'draws' or 'ties' in determining the winning teams. In the event of a draw, teams will be required to play the same map at a time determined by the Promoter until a clear winner is determined, in accordance with the Tournament Rules.
- Eligible Entrants who withdraw, suspend or otherwise cancel their GameArena membership before the end of the Promotion Period or who are in breach of the GameArena terms and conditions at any time during the Promotion Period will be ineligible to win a prize.
- The Promoter's decision in relation to the winners of the Promotion is final and binding and no correspondence will be entered into.
Prizes
- The Eligible Team that is the winner of the final game of the Tournament will receive from the Promoter a prize pack (valued at up to RRP $1,829.60, including GST), including:
- a cheque in the amount of $1000, including GST;
- 1 x PC game provided (and selected) by Electronic Arts (RRP $49.95) per member of the Eligible Team, up to a maximum of 8 games;
- 1 x $20 BigPond Music Voucher per member of the Eligible Team (up to a maximum of 8 vouchers); and
- 3 months' free access to the Battlefield Bad Company 2 server with 32 slots, valued at $90 per month (total RRP $270),
("Major Prize"). The Major Prize will be awarded to the captain of the winning team to be distributed in his or her discretion.
- The Eligible Team that is the runner-up of the final game of the Tournament will receive from the Promoter a prize pack (valued at up to RRP $1,249.60, including GST), including:
- a cheque in the amount of $500, including GST;
- 1 x PC game provided (and selected) by Electronic Arts (RRP $49.95) per member of the Eligible Team, up to a maximum of 8 games;
- 1 x $10 BigPond Music Voucher per member of the Eligible Team (up to a maximum of 8 vouchers); and
- 3 months' free access to the Battlefield Bad Company 2 server with 32 slots, valued at $90 per month (total RRP $270),
("Runner-Up Prize"). The Runner-Up Prize will be awarded to the captain of the winning team to be distributed in his or her discretion.
- The two Eligible Teams that progress to the semi-final games of the Tournament, but not the final game of the Tournament, will each receive from the Promoter a prize pack (valued at RRP $520, including GST), including:
a cheque in the amount of $250, including GST; and
3 months' free access to the Battlefield Bad Company 2 server with 32 slots, valued at $90 per month (total RRP $270),
- (each a "Second Runner-Up Prize"). Each Second Runner-Up Prize will be awarded to the captain of the winning team to be distributed in his or her discretion.
- The four Eligible Teams that progress to the quarter-final games of the Tournament but not the semi-final games of the Tournament will each receive from the Promoter 1 month's free access to the Battlefield Bad Company 2 server with 32 slots, valued at RRP $90 (each a "Third Runner-Up Prize"). Each Third Runner-Up Prize will be awarded to the captain of the winning team to be distributed in his or her discretion.
- Total value of the prize pool is up to $4,479.20 (including GST).
- The winning Eligible Teams will be notified by email (to the contact email address provided by the Eligible Team) by 13 May 2010. The names of the winning Eligible Teams and their members will be published on the Competition Website on 13 May 2010.
- Prizes are not transferable or exchangeable and are not redeemable for cash. All other costs associated with the Prizes are the responsibility of the winners.
- If a winner decides not to accept the Prize or a component of it, they forfeit that Prize or component. The Promoter is not obliged to provide a cash equivalent.
- The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. No responsibility will be taken for lost, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
- If, for any reason, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, subject to State and Territory regulations.
- If the Promoter is unable to provide a winner with the nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value.
- Any Eligible Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process (including the Tournament Rules), will be ineligible to win.
- The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry and the Promoter's decision in relation to any aspect of the Promotion is final and binding on each person who enters. No correspondence will be entered into.
- In the event that there is a dispute concerning the conduct of the Promotion, including whether an Eligible Entrant has cheated or breached the Tournament Rules in any way or where Eligible Entrants or Eligible Teams have disputed the result of a Game, the decision of the Promoter is final and no correspondence will be entered into.
Electronic Arts Pty Ltd
- The Promotion is organised by the Promoter, which is responsible for administering the Promotion and awarding prizes. All enquiries should be addressed to: Brent Artindale, Telstra Corporation Limited, Level 7, 151 Clarence Street, Sydney NSW 2000.
- By entering the Promotion, entrants acknowledge and agree that Electronic Arts is not to be held responsible by entrants in any way in relation to the administration of the Promotion and that Electronic Arts will not entertain any correspondence from entrants or third parties in relation to the same. Electronic Arts' ownership of all intellectual property rights in the Battlefield Bad Company 2 game, and any Electronic Arts logos, trade marks and copyright material used by entrants in this Promotion is asserted and all its rights reserved.
- By entering the Promotion, the Eligible Entrant acknowledges that information provided by the Eligible Entrant will be collected by Mammoth Media ("Mammoth Media Pty Ltd") on behalf of the Promoter for the purposes of conducting the Promotion. Mammoth Media will provide the Promoter all information collected about the Eligible Entrant during the course of the Promotion Period. The Eligible Entrant understands and agrees that the Promoter may use and disclose the information provided by the Eligible Entrant on the terms and for the purposes (including marketing) set out in the Promoter's Privacy Statement available at www.telstra.com.au/privacy/privacy_statement.html or by calling 1800 039 059. If the Eligible Entrant would like to access or correct the personal information that the Promoter holds about the Eligible Entrant, or if the Eligible Entrant does not wish the information to be disclosed, the Eligible Entrant should advise the Promoter by phoning 1800 039 059.
- By entering into the Promotion, the Eligible Entrant agrees and acknowledges that:
- the Eligible Entrant may be contacted by the Promoter to provide comments about the competition and the Promoter (or an agent of the Promoter) may take photos of the winner;
- the Promoter may use such comments or photos (the "Materials") for the Promoter's future promotional and marketing purposes without further reference or compensation to the Eligible Entrant;
- the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
- by entering the Promotion, the Eligible Entrant grants to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;
- the Eligible Entrant unconditionally and irrevocably consents to any act or omission that would otherwise infringe any of the Eligible Entrant's moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");
- the Eligible Entrant waives all Moral Rights in the Materials that arise outside Australia; and
- the Eligible Entrant agrees not to institute, maintain or support any claim or proceeding for infringement of the Eligible Entrant's Moral Rights in the Materials.
- To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained in connection with this Promotion.
- The Promoter accepts no responsibility for any tax liabilities that may arise from winning a prize.
